An easement is the right to a specific use of another party’s real property.

Comment

The easement is recorded as an interest in the property that remains in the possession of the owner. Easements may be affirmative easements granting the right to do something (e.g., place power lines on the property) or negative easements prohibiting a certain action (e.g., preventing neighbors from building extra stories that would block sunlight). They also may be attached to a property no matter who the owner is or whether ownership is transferred (known as easements appurtenant) or connected to a certain individual (known as easements in gross). An example of an easement is the right to cross over a property, known as a wayleave (e.g., the right to access power lines on the property) or other right of way (e.g., the right for rail tracks to cross property).

Poznámka

Služebnost se zaznamenává jako podíl na nemovitosti, která zůstává v držbě majitele. Služebnosti mohou být aktivní, které udělují právo něco činit (např. umístit na pozemek elektrické vedení) nebo záporná, které zakazují určitou činnost (např. brání sousedům ve výstavbě dalších podlaží, které by blokovaly sluneční světlo). Také je možné je připojit k nemovitosti bez ohledu na to, kdo je majitelem, nebo zda došlo k převodu vlastnictví (pozemková služebnost) nebo spojené s určitou osobou (osobní služebnost). Příkladem služebnosti je právo na překročení pozemku, známé jako právo průchodu (např. právo na přístup k elektrickému vedení na pozemku) nebo jiné právo cesty (v anglosaském právu např. právo na stavbu železnice napříč pozemkem).
